CONDITIONS OF CONTRACT AND OTHER IMPORTANT NOTICES

This Ticket is Not Valid and Will Not Be Accepted for Carriage Unless Purchased from Issuing Carrier or its Authorized Agent.

Notic

If the passenger’s journey involves an ultimate destination or stop in a country other than the country of departure the Warsaw Convention may be applicable and the Convention governs and in most cases limits the liability of carriers for death or personal injury and in respect of loss of or damage to baggage. See also notices headed “Advice to International Passengers on Limitation of Liability” and “Notice of Baggage Liability Limitations”.

Conditions of contract

1. As used in this contract “ticket” means this passenger ticket and baggage check, or this itinerary/receipt if applicable, in the case of an electronic ticket, of which these conditions and the notices form part, “carriage” is equivalent to “transportation”, “carrier” means all air carriers that carry or undertake to carry the passenger or his baggage hereunder or perform any other service incidental to such air carriage, “electronic ticket” means the Itinerary/Receipt issued by or on behalf of Carrier, the Electronic Coupons and, if applicable, a boarding document. “Warsaw Convention” means the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw, 12th October 1929, or that Convention as amended at the Hague, 28th September 1955, whichever may be applicable.
2. Carriage hereunder is subject to the rules and limitations relating to liability established by the Warsaw Convention unless such carriage is not “international carriage” as defined by that Convention.
3. To the extent not in conflict with the foregoing, carriage and other services performed by each carrier are subject to: (i) provisions contained in the ticket; (ii) applicable tariffs; (iii) carrier’s conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of carrier), except in transportation between a place in the United States or Canada and any place outside thereof to which tariffs in force in those countries apply.
4. Carrier’s name may be abbreviated in the ticket, the full name and its abbreviation being set forth in carrier’s tariffs, address shall be the airport of departure shown opposite the first abbreviation of carrier’s name in the ticket; the agreed stopping places are those places set forth in this ticket or as shown in carrier’s timetables as scheduled stopping places on the passenger’s route; carriage to be performed hereunder by several successive carriers is regarded as a single operation.
5. An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its Agent.
6. Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representatives of carrier and any person whose aircraft is used by carrier for carriage and its agents, servants and representatives.
7. Checked baggage will be delivered to bearer of the baggage check. In case of damage to baggage moving in international transportation complaint must be made in writing to carrier forthwith after discovery of damage and, at the latest, within seven days from receipt; in case of delay, complaint must be made within 21 days from date the baggage was delivered. See tariffs or conditions of carriage regarding non-international transportation.
8. This ticket is good for carriage for one year from date of issue, except as otherwise provided in this ticket, in carrier’s tariffs, conditions of carriage, or related regulations. The fare for carriage hereunder is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid.
9. Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in timetables or elsewhere are not guaranteed and form no part of this contract. Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice. Carrier assumes no responsibility for making connections.
10. Passenger shall comply with Government travel requirements, present exit, entry and other required documents and arrive at airport by time fixed by carrier or, if no time is fixed, early enough to complete departure procedures.
11. No agent, servant or representative of carrier has authority to alter, modify or waive any provision of this contract.

CARRIER RESERVES THE RIGHT TO REFUSE CARRIAGE TO ANY PERSON WHO HAS ACQUIRED A TICKET IN VIOLATION OF APPLICABLE LAW OR CARRIER’S TARIFFS, RULES OR REGULATIONS.

ADVICE TO INTERNATIONAL PASSENGERS ON LIMITATION OF LIABILITY

Passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised that the provisions of a treaty known as the Warsaw Convention may be applicable to the entire journey, including any portion entirely within the country of origin or destination. For such passengers on a journey to, from or with an agreed stopping place in the United States of America, the Convention and special contracts of carriage embodied in applicable tariffs provide that the liability of certain carriers, parties to such special contracts, for death of or personal injury to passengers is limited in most cases to proven damages not to exceed US$75,000 per passenger, and that this liability up to such limit shall not depend on negligence on the part of carrier. For such passengers traveling by carrier not a party to such special contracts or on a journey not to, from, or having an agreed stopping place in the United States of America, liability of the carrier for death or personal injury to passengers is limited in most cases to approximately US$10,000 or US$20,000. The name of carriers, parties to such special contract, are available at all ticket offices of such carriers and may be examined on request. Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the carrier’s liability under the Warsaw Convention or such special contracts of carriers. For further information please consult your airline or insurance company representative.

Note: The limit of liability of US$75,000 above is inclusive of legal fees and costs except that in the case of a claim brought in a state where provision is made for separate award of legal fees and costs, the limit shall be the sum of US$58,000 exclusive of legal fees and costs.

NOTICE OF BAGGAGE LIABILITY LIMITATIONS

Liability for loss, delay, or damage to baggage is limited unless a higher value is declared in advance and additional charges are paid. For most international travel (including domestic portions of international journeys) the liability limit is approximately U.S.$9.07 per pound (U.S.$20.00 per kilo) for checked baggage and U.S.$400.00 per passenger for unchecked baggage. For travel wholly between U.S. points, Federal rules require any limit on an airline’s baggage liability to be at least U.S.$2500.00 per passenger. Excess valuation may be declared on certain types of articles. Some carriers assume no liability for fragile, valuable or perishable articles. Further information may be obtained from the carrier.

NOTICE OF GOVERNMENT IMPOSED TAXES, FEES AND CHARGES

The price of this ticket may include taxes, fees and charges which are imposed on air transportation by government authorities. They may represent a significant portion of the cost of air travel and are either included in the fare, or shown separately in the “TAX/FEE/CHARGE” box(es) of this ticket. You may also be required to pay taxes or fees or charges not already collected.
The following notice does not apply to tickets sold in the United States for transportation originating in the United States.

Denied Boarding by Overbooking

In those countries where Denied Boarding Compensation regulations are in force, carriers operate compensation plans for passengers with confirmed reservations who are denied boarding because of non-availability of seats caused by overbooking. Details of these plans are available at the airlines’ offices.

Check-in Times

The times shown on this ticket or itinerary/receipt if applicable are the departure times of the aircraft. Check-in times, as advised by your carrier, or in the airlines’ timetable, are the latest times at which passengers can be accepted for travel, allowing the necessary time to complete all formalities. Flights cannot be held up for passengers arriving late, and no responsibility can be accepted in such cases.

BAGGAGE: Checked Baggage: Passengers are usually permitted a free checked baggage allowance, the limit of which may differ by airline, class, and/or route. Extra charges may apply for checked baggage in excess of the permitted allowance. Cabin Baggage: Passengers are usually permitted a free cabin baggage allowance, the limit of which may differ by airline, class, route, and/or aircraft type. It is recommended that cabin baggage be kept to a minimum. Please ask your travel agent or airline for more specific information.

Dangerous Articles in Baggage

For safety reasons, dangerous articles must not be packed in checked or carry-on baggage. Restricted articles include but are not limited to: compressed gases, corrosives, explosives, flammable liquids and solids, radioactive materials, oxidizing materials, poisons, infectious substances, and briefcases with installed alarm devices.

CONDITIONS OF CONTRACT AND OTHER IMPORTANT NOTICES

この航空券は、発行運送人又はその指定代理店から購入した場合でなければ有効ではなく、また運送を引き受けられません。

ご注意

旅客が出発国以外の国に最終到達地又は寄航地を有する旅行を行なうときは、その旅客の運送は、死亡又は身体の障害及び手荷物の滅失又は毀損の場合における運送人の責任を通常制限するワルソー条約の適用を受けることがあります。なお、「国際旅客への責任制限に関するお知らせ」の注意書をご参照下さい。

契約条件

1. この契約で使用する場合において、「航空券」とは、この旅客の切符及び手荷物切符、又はE チケットの場合にはこの旅程表/領収書をいい、これらの契約条件及び上記注意書はその一部をなしており、「運送」とは、「輸送」と同義語であり、「運送人」とは、この航空券により旅客若しくはその手荷物を運送し又は運送を引受け、又は当該航空運送に付随するその他の業務を行なうすべての航空運送人をいい、「E チケット」とは、運送人又は運送人の代理人によって発行された旅程表/領収書・電子用片、搭乗書類をいいます。「ワルソー条約」とは、1929 年10 月12 日にワルソーで署名された国際航空運送についてのある規則の統一に関する条約又は1955 年9 月28 日にヘーグで改正されたワルソー条約のうちいずれか適用するものをいいます。
2. この航空券による運送は、その運送がワルソー条約で定義された「国際運送」でない場合でなければ、ワルソー条約に定める責任に関する規定及び制限の適用を受けます。
3. 上記と抵触しない範囲内において各運送人が行なう運送及びその他の業務は、（�T）この航空券に記載された規定、（�U）適用タリフ、（�V）この契約条件の一部をなす、運送人の運送約款及び関係規則（これらは要求に応じて運送人の事務所で閲覧できます）の適用を受けます。ただし、アメリカ合衆国又はカナダのある地点とその国外の地点との間の輸送にはそれらの国で有効な約款が適用します。
4. 運送人の正式名称およびその略号は運送人のタリフ、運送約款、規則又は時刻表に記載されており、運送人の名称はこの航空券面に略記することがあります。 運送人の住所は、この航空券面上の運送人の最初の名称略号の反対側に記載されている出発空港とします。予定寄航地は、旅客の旅程上の予定寄航地としてこの航空券に記載され又は運送人の時刻表に示されている寄航地とします。この航空券により2 以上の運送人が相次いで行なう運送は、単一の取扱とします。
5. 他の航空運送人の路線の運送の為に航空券を発行する航空運送人は、当該地の航空運送人の代理人としてのみ、これらの行為をします。
6. 運送人の責任の排除又は制限に関する一切の規定は、運送人の代理人、被用者及び代表者並びに運送の為に運送人が使用する航空機の保有者並びにその代理人、被用者及び代表者にも適用します。
7. 受託手荷物は手荷物切符の所持人に引渡します。国際輸送として運送される手荷物に毀損があった場合には、異議は毀損の発見後直ちに、遅くともその受取りの日から7 日以内に運送人に対して書面でなされなければならず、遅延の場合には、異議はその手荷物が引渡された日から21 日以内になされなければなりません。
8. この航空券、運送人のタリフ、運送約款又は関係規則に別段の定めのある場合を除き、この航空券は発行日から1 年間運送に対して有効です。この航空券による運送のための運賃は運送開始前に変更されることがあります。運送人は、適用運賃の支払がなされていない場合には、輸送を拒絶することがあります。
9. 運送人は、相当なる早さで旅客及び手荷物を運送するために最善の努力を払うようにします。時刻表又はその他のところに示されている時刻は保証されたものではなく、また、この契約の一部をなすものではありません。運送人は予告なしに運送人を他の運送人に変更し又は航空機を他の航空機に変更することができ、また、必要な場合には、この航空券に示されている寄航地を変更又は省略することができます。スケジュールは予告なしに変更されます。運送人は接続をなすことにつき一切責任を負いません。
10. 旅客は官公署の定める旅行要件に従うものとし、出入国書類その他の必要書類を提示し、運送人が指定する時刻までに又は時刻を特に指定していないときは、搭乗手続きを完了できるよう十分な余裕をもって空港に到着するものとします。
11. 運送人の代理人、被用者又は代表者は、この契約のいかなる規定をも変更若しくは改訂し又はいかなる権利をも放棄する権限を有しません。

運送人は適用ある法令又は運送人のタリフ若しくは関係規則に違反して航空券を取得した者に対しては、運送を拒否する権利を留保します。

国際旅客への責任制限に関するお知らせ

旅客が出発国以外の国に最終到達地又は寄航地を有する旅行を行なうときは、ワルソー条約と呼ばれている条約の規定が出発国又は到達国の国内区間を含む全区間に対して適用することがあります。アメリカ合衆国内の地点を出発地、到達地又は予定寄航地とする旅行をする旅客の場合には、同条約及び適用タリフに定められている特別運送契約により、当該特別契約に加入している運送人の、旅客の死亡又は負傷その他の身体の障害に対する責任はほとんどの場合に旅客1 人当り75,000 米国ドルを超えない証明された損害額に制限され、また、当該限度までの責任は運送人側の過失を条件とするものではないと定められています。当該特別契約に加入していない運送人により旅行する旅客の場合又はアメリカ合衆国内の地点を出発地、到達地又は予定寄航地としていない旅行をする旅客の場合には、旅客の死亡又は負傷その他身体の障害に対する運送人の責任は、ほとんどの場合に約10,000 米国ドル又は約20,000 米国ドルに制限されています。上記特別契約に加入している運送人の名称は当該運送人の航空券発券事務所で供覧しており、要求により閲覧することができます。保険会社に保険を付することによって、通常上記補償に追加して補償を得ることができます。当該保険はワルソー条約又は上記特別運送契約に定める運送人の責任制限によって影響されることなく付保できます。詳細についてはご搭乗の航空会社又は保険会社の職員にご相談下さい。

おことわり：上記の責任限度の75,000 米国ドルは訴訟の費用及び経費を含む額です。ただし、訴訟の費用及び経費を別途裁定する国において提起された賠償請求の場合には、その限度は訴訟の費用及び経費を除く58,000 米国ドルとします。

手荷物に対する責任限度についてのお知らせ

手荷物の滅失、紛失、遅延又は毀損に対する航空会社の責任には、旅客が事前により高い価額を申告し、かつ、増料金を支払っているのでなければ、限度があります。ほとんどの国際旅行（国際旅行の一部を構成する国内旅行区間を含む）に対する責任限度は、受託手荷物の場合、1 ポンド当り約9.07 米国ドル（1 キログラム当り約20.00 米国ドル）、持込手荷物の場合、旅客1 人当り約400 米国ドルとされております。米国国内区間のみの旅行に対しては、米国連邦規則により、航空会社の手荷物に対する責任限度は、旅客1 人当り少なくとも2500.00 米国ドルとするように規定されております。ある種の物品については、限度額を超える価額を申告することができます。破損しやすいもの、高価なもの（註）又はくさりやすいものに対する責任を負わない航空会社もあります。詳細は航空会社にお問い合わせ下さい。
（註：上記文中「高価なもの」とは、貨幣、宝石類、銀製品、有価証券、証券その他の高価品、見本又は書類等をいいます。）

各国政府によって課せられた税金・手数料等について

この航空券の価格には各国政府によって航空運送に課せられた税金・手数料等が含まれている場合があります。これらの税金・手数料等は、航空旅行費用のかなりの部分を占めることもありますが、航空運賃の中に含まれている場合と航空券の税金欄に別個に表示されている場合があります。尚、これら税金・手数料等が予め徴収されていない場合には別途お支払頂く場合もあります。

下記のお知らせは、米国発旅程でかつ米国で販売された航空券には適用されません。

オーバーブッキングによりお座席が提供できない場合 DBC（注）が法制化された国において、オーバーブッキングにより、予約をお持ちのお客様に座席を提供できなかった場合、航空会社は規定による補償を行ないます。詳細につきましては、航空会社にご照会下さい。

チェックイン時刻

この航空券又は旅程表/領収書に示されている時刻は、航空機の出発時刻です。運送人により指定された、または航空会社の時刻表によって示されたチェックイン時刻は、全ての手続きを終了させるために必要な時間を考慮して設定された、旅客の搭乗手続き受付の締切時間です。旅客が遅れて到着しても航空便の出発を遅らせることはなく、一切の責任を負いません。

手荷物：

受託手荷物： 旅客には、通常、無料受託手荷物許容量が認められており、その限度は航空会社、クラス又は経路により異なることがあります。その許容量を超える場合は、超過料金が適用される場合があります。
持込手荷物： 旅客には、通常、無料機内持込手荷物許容量が認められており、その限度は航空会社、クラス、経路又は航空機の種類により異なることがあります。持込手荷物は最小限とすることをお勧め致します。詳細につきましては、旅行会社又は航空会社にお問い合わせ下さい。

手荷物における危険品について

安全上の理由から、危険品を受託手荷物や機内持込手荷物に入れることはできません。このような制限を受けるものは以下の物品が含まれますが、これらに限定されるものではありません。
高圧ガス、腐食性のある物、爆発物、可燃性液体・固体、放射性物質、酸化性物質、有毒物質、伝染性物質、アラーム機能を備えた書類かばん等。
